In I Divorce In New Jersey, What Type Of Questions Will I Be Asked?

In a simple divorce, the facts are pretty straightforward. However, in my 20 years of practicing divorce law here in New Jersey, I have learned that there are certain issues that may arise which are always controversial. In these cases, every lawyer in my office serves Interrogatories.

First, alimony is always a hotly contested. Always! This is one of the reasons that the New Jersey Alimony Reform movement resulted in a massive over haul and modernization of the alimony laws in our state.

Second, child custody. When your child’s welfare is at stake as well as your parent-child relationship, no other issue in a divorce can be more volatile and extremely fact sensitive.

Third, when one party is self-employed, is becomes difficult if not impossible to determine the other spouse’s equitable share of the value (as well as the value itself) and what the business owning spouse’s income truly is, as some folks get “funny with their money.”

Following, please find sample divorce or “matrimonial” interrogatories that will demonstrate to you how detailed the facts of a complicated or high-conflict divorce can become.

INSTRUCTIONS

A. When answering the following Interrogatories, provide any and all information either in your possession, under your control, within your dominion or available to you, regardless of whether this information is in your personal possession or possessed by your agents, servants, employees, representatives or others with whom you have a relationship and from whom you are capable of deriving information, documents or material.

B. If any Interrogatory is not answered in full, state the precise reason for failing to complete the answer. The answer "not applicable" is not acceptable. If a legal objection is made with respect to any Interrogatory, you should set forth the specific reason for such objection. If only a portion of an Interrogatory cannot or will not be answered, provide the fullest answer to the Interrogatory and thereafter specifically set forth (a) the fact that the answer is incomplete and (b) the reason or grounds for any omission and/or refusal to complete.

C. All Interrogatories require an answer even if the context of the question seeks only an affirmative response and the response you intend is not affirmative. Thus, if any answer is left blank, it shall be deemed to be "none."

D. All head notes in the within Interrogatories are for reference only and are not intended to qualify or limit context of any question appearing thereunder.

DEFINITIONS

As used herein the following terms shall have the meanings indicated:

"Document" shall mean the original and any copy, regardless of origin or location, of any book, pamphlet, periodical, letter, memorandum, telegram, report, records, study, handwritten note, working paper, chart, photograph, index, tape data sheet or data processing card or any other written, recorded, transcribed, punched, taped, filmed or graphic matter, however produced or reproduced, to which you have had access.

The term "reliance" includes any use of such documents including but not limited to, the following:

(i) Reference to any such document by any witness as a basis for establishing any fact upon which reliance is made; or

(ii) Reference to any such document by any expert witness as a basis for his opinion; or

(iii) Introduction into evidence for any purpose; or

(iv) References to any such document by any witness or by your attorney for the purpose of cross-examination, to refresh the recollection of a witness, to impeach the credibility of any witness or for any other purpose.

"Person" shall include natural persons, proprietorships, corporations, partnerships, groups, associations and organizations.

"Oral Communication" shall mean any utterance heard by another person, whether in person, by telephone or otherwise.

"Identify" when used in reference to an individual person shall mean state his full name, residence address, present or last known position and business affiliation and his position and business affiliation at the time in question.

"Identify" when used in reference to a corporation shall mean state its full name and the address of its principal office.

All requests to "identify" any document require the answer to include a description of each document, a summary of the content thereof, the name of each person, firm, corporation or other entity signing or executing the same and the date thereof. If the document is commercially printed or published, the name and address of the printer or publisher are required. Any document containing images (i.e. charts, photographs, etc.) shall contain a description thereof.

The term "You" or "Your" refers to the ________________, ________________, and shall mean any of her consultants, experts, officers, former officers, agents, former agents, employees, former employees, assignees or successors, parent organizations, affiliates, or subsidiaries, or any and all other persons or entities acting on her behalf or with her authorization. The term "You" or "Your" may be set in lower case throughout the General Instructions, Definitions and Interrogatories.

BASIC INFORMATION :

1. Please state the following:

a. Your full name (including any other name, alias, or nickname by which you have been known).

b. Your age and date of birth.

c. Your residence and post office address.

d. Your home telephone number.

e. Your social security number.

2. With regard to the _________________’s present address, state in whose name the title to this property is recorded.

a. If rented pursuant to a written lease, identify the lease and annex a copy of same hereto.

b. If rented pursuant to an oral lease, set forth all terms thereof, specifying all payments which you are required to make.

RESIDENCE PRIOR TO DIVORCE ACTION

3. Set forth the addresses of all locations at which the ______________ has resided within the five years immediately preceding the commencement of this action.

4. Set forth the name, age and relationship to the _________________ of each person with whom you share your present residence, and list all contributions made by each said person toward living expenses, rental and/or maintenance of said premises.

CHILDREN

5. Were any children born or adopted during this marriage? If your answer is "yes", please set forth:

a. The name and birth date of every child born to the ________________ or adopted by the _______________ during this marriage.

b. Whenever and how each such child is financially dependent upon the _________________.

c. Whether any the _________________’s dependent children from this marriage has any disability or extraordinary educational, medical or other financial needs and what they are.

1. How many hours per day and per week is the child(ren) at a babysitter or daycare?

2. Where the child(ren) is cared for and by whom, stating the full name and address of each such babysitter or daycare provider.

4. The cost for same (per hour, flat rate per week) and the manner of payment.

e. Persons authorized to draw on the account;

g. Present balance (if closed, last balance in existence during the past three (3) years)

h. The yearly interest on any accounts in existence during the past years;

i. List the balance in each account during the past three (3) years as of December 31st of each year;

j. If you withdrew $250.00 or more from any accounts in existence during the past three (3) years, set forth the amount, date of withdrawal and reason for same;

k. Attach all bank statements for the past 18 months from each of the depositories.

7. Does the _________________ have any dependents other than the child(ren) listed in your answer to interrogatory number 5 above?

If your answer is "yes", for each dependent, set forth:

a. His/Her name, birthday, address and relation to you.

b. The amount of money expended per month in the support of such dependent.

HEALTH

COMMISSION INCOME

22. With regard to any employment, independent contracting or other position that you have held during the past five (5) calendar years, including your current position, please set forth:

a. The amount of commission income that you have earned for each of the preceding five (5) calendar years, and the current year-to-date.

b. The name(s), address(es) and phone number(s) of any person(s) or entity that has paid any said commission(s) to you over the last five (5) calendar years including the current year-to-date.

c. Describe the basis upon which any said commission(s) are calculated.

d. Attach copies of any and all documentation, including 1099's, with respect to all such commissions(s).

BONUS INCOME

23. With regard to any employment, independent contracting or other position that you have held during the past five (5) calendar years, including your current position, please set forth:

a. The amount of value of any bonus received by you in any of the past five (5) calendar years including the current calendar year-to-date.

b. The name(s), address(es), and phone number(s) of any person(s) or entity who has paid any such bonus to you over the last five (5) years including the current year-to-date.

c. The nature of the said bonus(es) such as cash, automobile, stock, etc.

d. Describe the basis of your valuation of any such bonus(es).

k. Where said funds are on deposit and how held (cash, insurance policies, etc.) and identifying numbers or date with respect to each such amount.

l. Nature and extent of and withdrawal or borrowing privileges with respect to such plan.

m. All circumstances in which the benefit becomes available to you and method of payment thereof.

n. If you are still a participant in the plan and the amount of your monthly pension payment which you would receive at the age of 65, including all settlement options available.

o. Whether any of the benefit is available to you presently or upon separation from services.

i. Attach copies of the most recent summary plan description.

j. Attach copies of the corporate resolution adopting the plan/trust and any subsequent resolutions pertaining to approval.

k. Attach a completed Employee Census for all employees as of the most recent plan anniversary (data sheet).

l. Attach a copy of the trust asset statement as of the most recent plan anniversary (data sheet).

m. If there are individual insurance or annuity contract(s) in force in the plan, attach copies of the actual contract(s).

n. If this is a profit-sharing or defined contribution pension plan, attach copies of records of the individual account balance as of the last valuation date.

o. List the name of the directors of the corporation.

p. List the names of the shareholders of the corporation and the percentage of stock owned.

q. List the names of the officers of the corporation and their titles.

r. Is the corporation part of a controlled group of corporations?

If so, provide the following information for all corporations:

1. Names of directors of corporations.

2. Names of shareholders of corporation and the percentages or stock owned.

3. Names of officers of corporation and their titles.

s. Are there any other plans in effect in the corporation? (Include qualified, non-qualified, excess benefit, active or frozen, corporate or KEOGH).

t. Is the corporation a regular corporation or a Subchapter S corporation?

u. If this is a defined benefit pension plan, attach a copy of the latest actuarial valuation specifying cost methods and all actuarial assumptions being used.

v. Set forth amount of your salary for the last five (5) years on a year-to-date basis.

w. Have there been any loans made from this plan?

If so, attach a copy of the note signed in support of the loan.

x. Does any form of employment agreement or contract exist?

If "yes", attach an executed copy.

y. List all other portions of the employees' benefits package, e.g., life, health, disability insurance, stock options, any benefit designed or intended to avoid inclusion in the employee's estate which is payable to someone other than the employee.
